Texas Child Custody: Possession and Access & Conservatorship
If you are going through a divorce in Texas, chances are that you are overwhelmed
by a flood of questions. When children are involved, we realize that this
adds a whole other level of stress and concern as you determine your custody
arrangement with your ex-spouse. A lot of questions parents have are related
to how much time they will get with their child or children. Will they
have sole custody or do they want a joint custody agreement? Who will
make all of the important decisions about their child’s life?
Texas State court puts all child custody issues into two different categories:
- Possession and Access – This refers to which parents have physical
custody over the children and also determines any visitation rights. Parents
will have to come to an agreement on a schedule of when each parent can
visit or have custody of the child, choosing either a standard or extended schedule.
- Conservatorship – This involves the basic rights and responsibilities
of each parent and whether or not they will be making the final call on
medical decisions, schooling, religious upbringing, etc. There can either
be Sole Managing Conservatorship, allowing only one parent to make these
decisions; or there can be Joint Managing Conservatorship, allowing both
parents to choose together.
No matter the type of custody arrangement you want, it is in your best
interest to have an attorney by your side to protect your rights throughout
the divorce process. If you and your spouse cannot come to a mutual decision
about custody, the court may end up deciding it for you.
